Hello! We are Bons Websistemes SL (“Astromodus”, “we”, “us”). Thank you for reading this document.
These Terms of Service (“Terms”) govern your access to and use of the Astromodus.com website (“Website”), as well as any related web applications, mobile applications (if available), and other features/products provided by us (collectively, the “Services”).
When you first access the Services, you will be asked to read and accept these Terms and our Privacy Policy. Your use of the Services and the processing of your data are governed by these two documents, and you may not use the Services without expressly agreeing to them.
1. Contractual provisions
Limitation of liability
Under no circumstances shall Astromodus, nor its creators, owners, and developers, be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- your access to or use of, or inability to access or use, the Services;
- any conduct or content of any third parties within the Services;
- any content obtained through the Services; and
- unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been advised of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose.
Disclaimer
Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Astromodus and its creators do not warrant that: a) the Services will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements.
Astrological materials, forecasts, interpretations, recommendations, and any other content in the Services are for informational and entertainment purposes only and do not constitute professional advice (including medical, psychological, legal, or financial advice). You make your own decisions and bear full responsibility for them.
Changes to the Terms
We are constantly improving the Services, so we may need to change these Terms from time to time. We will notify you of any such changes by posting a notice on Astromodus.com, sending you an email, or by other means. If you have chosen not to receive legal notices from us by email (or you have not provided us with your email address), such legal notices will still govern your use of the Services, and you remain responsible for reading and understanding them. If you use the Services after changes have been posted, it means you agree to all changes.
Governing law
These Terms are governed by and construed in accordance with the laws of Andorra, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Services and supersede and replace any prior agreements that may have existed between us regarding the Services.
2. Privacy
We take your privacy seriously. The rules for processing personal data and using information are described in detail in the Astromodus Privacy Policy.
3. Use of the Services
You will use the Services only for personal, non-commercial use and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws applicable to you. If your use of the Services is prohibited by applicable law, you are not authorized to use them. We cannot and will not be responsible for any use of the Services in violation of the law.
If the Services provide for an account, you will not share the account or password with anyone and must protect the security of your account, password, and any other means of access or credentials. You are responsible for any activity associated with your Astromodus account.
4. Responsibility
Content in the Services
Any information or content available through the Services is used by you at your own risk. We are not responsible for any errors or omissions in such information or content or for any loss or damage you may incur in connection with it. We cannot control and are not required to take any action regarding how you may interpret and use the content or what actions you may take as a result of having accessed the content. You hereby release us from all liability for any content you did or did not obtain through the Services.
User-provided data and materials
Some Astromodus features may require the input of data (e.g., date/time/place of birth) or other materials. You are responsible for the accuracy of the data you provide and for all content you submit to the Services. You represent and warrant that you have all rights necessary to provide such content and data in the form in which you provide them.
You should be fully aware of any sensitive content you may enter or store and consider the risks associated with providing it.
5. Availability and purchases
You acknowledge and agree that Astromodus may offer the purchase of credits (“Credits”) - virtual units used to access certain paid features/materials (“Paid Features”). Payment for Credit bundles is charged as a one-time payment.
Credit bundles and pricing
The following Credit bundles may be offered on Astromodus.com (prices are in US dollars, USD):
- 10 🔹 - $10 ($1.00 per 1 🔹, no discount)
- 30 🔹 - $25 ($0.83 per 1 🔹, 16.67% discount)
- 50 🔹 - $35 ($0.70 per 1 🔹, 30% discount)
- 100 🔹 - $60 ($0.60 per 1 🔹, 40% discount)
- 500 🔹 - $200 ($0.40 per 1 🔹, 60% discount)
- 1000 🔹 - $350 ($0.35 per 1 🔹, 65% discount)
Note: the discount is calculated relative to the base price of $1.00 per 1 🔹 (the 10 🔹 bundle for $10). Actual displayed prices, taxes, and fees may depend on your country/payment method and will be shown before you complete your purchase.
Use of Credits
Credits are tied to your account (if applicable), are non-transferable to third parties, have no cash value, and are not a means of payment outside Astromodus. The cost of Paid Features in Credits is shown in the Services interface and may change.
Payment
A valid payment method is required to process payment. Payments are processed by third-party payment providers and/or app stores (if applicable). Payment information is managed by such third parties and is not stored by Astromodus (except for technical transaction/status identifiers if necessary to deliver the purchase and provide support).
Price changes
Astromodus may, at its sole discretion and at any time, change the prices of Credit bundles and/or the cost of Paid Features in Credits. Any changes take effect upon publication/display in the Services (unless otherwise required by mandatory provisions of law).
Refund policy
We are confident in the quality of our product and provide the option to request a refund for the purchase of a Credit bundle within 14 days from the date of purchase, provided that the purchased Credits have not been used (or that the corresponding Paid Feature has not been delivered/provided). If the purchase was made through an app store, refunds may be governed by that store’s policies.
To request a refund within the allowed period, please send a free-form request by email to [email protected] or use the feedback form on our website (if available). The request will be processed, and the refund (if approved) will be issued within 10 business days from receipt of the request.
6. Termination
Termination by you
You may stop using the Services at any time. If you want to close your account (if applicable) or contact us regarding payments/refunds, you can reach us at [email protected].
Termination by us
We may suspend or terminate your access to the Services as a result of your fraud, abuse, or breach of any obligations under these Terms. Such termination or suspension may be immediate and without notice.
